Regarding DEM Member

I have been Pked 2 times by EphraimLancer, I hit him with a fireaxe a couple of times before he killed me but that was because he destroyed about 5 generators with fuel (4 in thompson mall and 1 in the cheeke building right next to the mall). So I am wondering is he really allowed to destroy generators without punishment and then PK me?
